Borderpass software is not a law firm but a tool to guide you through the visa application process prior to review by a Canadian immigration lawyer. The Borderpass software does not provide legal services, advice, consultation or recommendation to any person or entity that creates a BorderPass account as a customer ("Users"). BorderPass only provides a brokerage relationship between immigration attorneys and users. BorderPass does not establish an attorney-client relationship with a User through its Q&A platform and is not involved in any communication between attorneys and Users, or any agreement between attorneys and Users. Attorneys are not employees or agents of BorderPass but are independent service providers using BorderPass as a tool to help provide their services to Users.

1.5 Information provided by Institution
Requirements for admission and active enrolment into a DLI in Canada will include those of the Governments of Ontario and Canada and ensure that you abide by Canadian immigration rules, regulations, and laws, and the conditions on my study or work permit and Temporary Resident Visa (TRV) & Electronic Travel Authorization (eTA). In order to ensure you are abiding the requirements for admission, your institution may disclose your contact information and relevant documentation such as your valid Letter of Acceptance with BorderPass.

2. Use of Information We Collect
2.1. Account creation
We use the information you submit to us at the time of account registration, such as your name and email address, and any updated information you subsequently submit, such as a new email address, to create and manage your account.

We use your information, including Personal Information and Applicant Information, primarily to operate our business and provide the Services to you, including to complete immigration forms and letters. We use this information to personalize the Services we provide to you. We may share your information with BorderPass partners and affiliates to provide you with the Services you have requested. We may also use your information to verify your identity, for fraud prevention, to enforce applicable terms of use, and to protect the integrity of the site and to assess your creditworthiness. We may also use your information to develop new features or Services and to improve the quality of our Services.
2.3. Customer service and technical support
We may use your information, including Personal Information and Application Information, to respond to your questions regarding the use of our Services or to provide technical support and to assess your creditworthiness.
2.4. Communications with you
We may contact you using the contact information you provide in order to respond to inquiries you send to us, to communicate with you regarding our Services and the services of our partners, and to market our Services, or those of our partners, to you. If you are in the EU, we will only use your contact details to communicate with you regarding our partners' services with your prior consent. We may send you emails advertising or promoting our Services or those of our partners. We may use information about you, including Personal Information and Application Information, and other users, in aggregate form, for internal or external research and analysis and partnership purposes. For example, we may use certain types of your information to understand which features of our Services are used most frequently or to conduct research with outside research entities to improve Services and better understand outcomes and to impact policies including those within government and educational institutions. Additionally, we may also utilize this information to assist our partner academic institutions in identifying which prospective students or current students have registered for the BorderPass platform, with the specific purpose of aiding the institution in comprehending and reconciling usage for billing purposes.
2.6. Application Status
Your BorderPass attorney may from time to time share the status of your application with us, so that we can provide you with relevant background information about the steps in the application process. Specifically, you agree that we may share your information and data with BorderPass Lawyers and vice versa to help provide and maintain services to you.

3. Information Sharing and Disclosure
3.1. Your Privacy Rights
BorderPass does not share your Personal Information with third parties for their marketing purposes without your consent. BorderPass does not sell, rent, or lease its customer lists to third parties.
3.2. Upon Consent
We may share your information, including Personal Information, with third parties if you provide us with authorization to do so. For example, if you include Personal Information in a review or testimonial of our Services for posting to social media platforms, such information will be publicly disclosed upon posting.
3.3. Service Providers
We may share your Personal Information and Application Information with third-party service providers, but only to the extent necessary for them to assist us in providing our Services or Services that you request. For example, if you purchase Services, we will share your Billing Information with third-party payment processors to the extent necessary to process your payment. We use written contracts to require all third-party service providers to protect the security of your Personal Information, to keep your Personal Information confidential, and to use such information for no other purposes. If you request assistance with opening a bank account, we will share information necessary to facilitate that Service.
3.4. Responses to Legal Process, Subpoenas or Court Orders
We will not voluntarily disclose your Personal Information. However, we may disclose your Personal Information as required by law, such as in response to a court order, subpoena, or similar legal process legally requiring us to produce the information. If legally permitted and feasible, we will give you notice of our receipt of a demand for your Personal Information and provide you a reasonable time in which to seek to quash such demand in court, or otherwise obtain a withdrawal or modification of the demand, before complying with the demand.

Your Personal Information may be included in the event that some or all of our assets are sold, assigned or transferred in connection with a merger, acquisition, reorganization or sale of assets, or in the event of bankruptcy. As a general matter, however, an acquiring party cannot retroactively change the Privacy Notice that was in place when BorderPass collected your Personal Information.
3.6. Academic Research
We may share non-personally identifiable and non-privileged information about you and other users, in aggregate form, to third-party academic researchers. We require all third-party researchers to use such anonymized information for no purposes other than academic research. For example, we may use certain types of non-personally identifiable and non-privileged information to help researchers study factors that reduce barriers facing applicants navigating the immigration system. If you are in the EU, we will only share your non-privileged information with such academic researchers with your consent.

We use various third-party tracking technologies, such as cookies, web beacons, and analytics tools, to enhance user experience, analyze trends, and gather information about your interactions with our platform. We make the transfer to Canada in the absence of an adequacy decision because it is necessary for the performance of a contract with you, or with your explicit consent. We may transfer your personal data to a processor located outside of the EU to assist us in providing our Services. We enter standard contractual clauses with the processor for such transfers.

If you are located in the EU, you may use your account to access, correct, or change Personal Information that you have provided to us. You may also email us at hello@borderpass.ca to request access to, transfer of, and rectification or erasure of your Personal Information or restriction of processing; and to object to processing. In the email, specify the nature of your request and the information that is the subject of your request. We will respond to your request within 30 days.

If we are processing your personal data based upon the lawful ground of your consent, you have the right to withdraw your consent for such processing at any time without affecting the lawfulness of the processing based on consent before it is withdrawn. 6. Google Analytics and Amplitude

Amplitude collects information on how the Sites are being used, user behaviour and what data is being inputted into the Sites. Google Analytics collects only the IP address assigned to you on the date you visit this site, rather than your name or other Personal Information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this site, the cookie cannot be used by anyone but Google.
